Austrias Kapsch, the builder and operator of the Czech toll collection system, will appeal the decision of the Czech anti-trust body UOHS scrapping the first amendment to the contract between the state and Austrians as illegitimate, the company said.

Losses of the company as a result of this decision could reach dozens of millions of crowns, David Simonik of Kapsch said.

According to the secret amendment, made public only recently, Kapsch is obliged to maintain toll collection efficiency at 85 per cent compared to 95 per cent as the initial contract reads.

Moreover, if the collection rate exceeds 95 per cent, the Austrians are entitled to the entire surplus revenue.
